The 25th Amendment


Pelosi, Democrats Introducing Bill to Create Commission on 'Presidential Capacity'

House Speaker Nancy Pelosi (D-Calif.) and Rep. Jamie Raskin (D-Md.) announced a bill to create a "Commission on Presidential Capacity to Discharge the Powers and Duties of Office" that would possibly attempt to invoke the 25th Amendment of the Constitution to enable Congress to "help ensure effective and uninterrupted leadership in the highest office in the Executive Branch of government."

. . . According to the Constitution, Section 4 of the 25th Amendment allows Congress to come up with a body to declare whether a president is "unable to discharge the powers and duties of his office." 

"In emergency situations, Congress could pass a concurrent resolution requiring the Commission to examine the President, determine his/her ability to execute the powers and duties of the office, and report its findings to Congress. If presidential incapacity exists, the Vice President would immediately assume the role of Acting President," said Raskin's office in a news release. 

Raskin, without providing a reason, claimed that the "25th Amendment was adopted 50 years ago, but Congress has never set up the body it calls for to determine presidential fitness in the event of physical or psychological incapacity," while adding, "Now is the time to do it."

The move, along with Pelosi's comments, represents an escalation in Democrats' rhetoric that the 25th Amendment needs to be involved because Trump is incapable of leading. The long-shot move may also be designed to raise doubts about Trump's leadership with just weeks to go before the Nov. 3 election or an attempt to derail the Senate confirmation hearing for Amy Coney Barrett to the Supreme Court, scheduled for later in October.

According to Raskin, the body will include the "Speaker of the House, House Minority Leader, Senate Majority Leader, and Senate Minority Leader each select one physician and one psychiatrist to serve on the Commission." 

"Additionally, each party selects a retired statesperson (e.g., former Presidents, Vice Presidents, Attorneys and Surgeons General, Secretaries of State, Defense, and Treasury) to serve. The 10 appointed members then select an 11th member, who acts as the Chair of the Commission," it said.

"Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President," according to the section in the Constitution.

However, according to the Constitution, only Vice President Mike Pence can trigger the involuntary removal of Trump. If the president challenges Pence's move, then he would have to gain the support of the majority of Trump's cabinet as well as a supermajority in the House of Representatives and the Senate. Congress can also form a body approved "by law" to agree that "the President is unable to discharge the powers and duties of his office," according to the Constitution.

Next Debate Cancelled


Second presidential debate canceled by organizers 


The second presidential debate, scheduled for next Thursday between President Trump and Democratic challenger Joe Biden was canceled Friday by its organizers. 

The Commission on Presidential Debates, which runs the event, originally decided to make it a virtual, town hall style event after Trump tested positive last week for the coronavirus. 

However, the president declined earlier this week to participate in a virtual event, which was followed by the cancellation.

. . . "It is now apparent there will be no debate on October 15, and the CPD will turn its attention to preparations for the final presidential debate scheduled for October 22." 

The next debate will take place at Belmont University in Nashville, Tenn. Both candidates have agreed to participate in that debate. 

The debate will be divided into six 15-minute segments. The topics for the six segments will be selected and announced by the moderator, Kristen Welker of NBC News, at least one week before the debate.

Kidnapping Plot Overthrown


Grand Rapids, according to news reports. Six men were arrested by the FBI on Wednesday and charged with attempting to kidnap the governor, while seven others tied to the scheme were arrested and charged with state terrorism threats targetting law enforcement officers.

Whitmer has thanked law enforcement for foiling the plot but criticized President Trump for inciting violence. 

"Last week, the president of the United States stood before the American people and refused to condemn white supremacists and hate groups like these two Michigan militia groups," Whitmer, a Democrat, said during a Thursday news conference. "Stand back and stand by, he told them."

Since early 2020, the six men -- Adam Fox, Barry Croft, Ty Garbin, Kaleb Franks, Daniel Harris and Brandon Caserta -- had been allegedly plotting to kidnap Whitmer from her vacation home before Nov. 3, according to the Detroit Free Press. The men had been in communication on social media and met in the basement of a vacuum store in Grand Rapids.

. . . The FBI proceeded to track the militia group for the next two months until last week, when Fox and the others in his group met up in Ypsilanti on Wednesday to buy explosives so they could blow up a bridge near Whitmer's vacation house in order to keep police away. Agents were waiting to arrest the men when they arrived. 

If the men are convicted, they could face life sentences.

Trump Denounces Court-Packing


Trump blasts Biden over silence on court-packing question 


President Trump ripped Democratic presidential nominee Joe Biden during an exclusive interview on "Hannity" Thursday after the former vice president refused yet again to say whether he'd support efforts to add more seats to the Supreme Court. 

Trump spoke out hours after Biden said during a campaign stop in Phoenix that he would reveal his position on court-packing "when the election is over." 

"I think what he said was so disrespectful to the process and to the people," Trump told host Sean Hannity. "But what that means, really, is that they're going to do it, because obviously, that means 100 percent that's what they're going to do. They're going to end the filibuster and they're going to do things that you wouldn't have thought."

Republican lawmakers have vowed to confirm Judge Amy Coney Barrett to the Supreme Court before the Nov. 3 election. Barrett was nominated to fill the seat vacated by Justice Ruth Bader Ginsburg following her death in September. Trump has warned that top Democrats would move to "pack" the court with progressive judges in order to prevent a conservative majority.

"If they ever got in, day one, this would be the first move they make, [to] end the filibuster -- the nuclear option, as they call it -- and they will do that," the president said. "Not a week will go by, probably not a day will go by."

As the majority leader pointed out on Monday, the Senate Judiciary Committee may follow a "mix" of hybrid online and in-person questions and testimony from Nominee Judge Amy Coney Barrett.

Senate committees have held 150 hybrid hearings during the pandemic this year, more than 20 of which were by the Senate Judiciary Committee.

I am taking the lead on a letter from the IRF Roundtable asking President Trump to reimpose sanctions on Turkey under Executive Order 13994, which came out soon after Turkey's invasion of NE Syria last year. You or your organization signed the letter we sent last year asking for Presidential action against Turkey. This may have played a role in the imposition of sanctions. 

I am very happy to report that yesterday, the anniversary of the 2019 invasion, the President issued an order extending EO 13994 for another year. To me, this means that he is likely open to reimposing sanctions as we are now requesting. His announcement stated: "The situation in and in relation to Syria, and in particular the actions by the Government of Turkey to conduct a military offensive into northeast Syria, undermines the campaign to defeat the Islamic State of Iraq and Syria, or ISIS, endangers civilians, and further threatens to undermine the peace, security, and stability in the region, and continues to pose an unusual and extraordinary threat to the national security and foreign policy of the United States."
