3 More Jan. 6 Defendants Ask Supreme Court to Review Widely Charged Obstruction Felony
|

Three more criminal-case defendants have joined a petition seeking to have the U.S. Supreme Court review the U.S. Department of Justice’s (DOJ) novel use of an evidence-tampering statute to prosecute those who protested 2020 presidential election results at the Capitol on Jan. 6, 2021.
Defendants Christopher J. Warnagiris, 43, Christopher J. Carnell, 21, and William Robert Norwood III, 40, jointly filed an amici curiae brief ( pdf) with the Supreme Court in support of a petition for review of the law filed on July 7 by defendant Edward Jacob Lang, 28.
The men were charged with obstruction of an official proceeding—Title 18 U.S. Code Section 1512(c)(2)—a felony carrying up to 20 years in prison.
The DOJ was given an extended deadline—Sept. 29—by which to file a response to the petition for review.
An eventual Supreme Court ruling on the evidence-tampering statute could have far-reaching implications, as obstruction of an official proceeding is the most widely charged felony in Jan. 6 cases.

The stakes could not be higher, according to defense attorneys.
“It is no overstatement to say the future of the First Amendment hangs in the balance,” wrote attorneys Norman A. Pattis and Steven A. Metcalf in the July 7 petition (pdf) to the Supreme Court. “A statute intended to combat financial fraud has been transformed into a blatant political instrument to crush dissent.”
The attorneys expressed fears that prosecutions based on the obstruction charge could affect the 2024 presidential election.
“As the nation’s attention turns to the 2024 election, there is good reason to fear that the Justice Department’s current use of Section 1512(c)(2) will serve to chill political speech and expression on the eve of one of the most consequential events in American life – the election of the next President of the United States.” (The Epoch Times) Read more here.

Nancy Pelosi Is ‘Responsible’ for Jan. 6 After Turning Down Security Request: Trump

Former President Donald Trump is accusing Rep. Nancy Pelosi (D-Calif.) of being primarily responsible for the Capitol breach on Jan. 6 as she turned down his offer of deploying 10,000 soldiers prior to the incident.
“I offered 10,000 people to the mayor of Washington D.C. and Nancy Pelosi … and they turned it down flat,” President Trump said in a Sept. 17 interview with NBC’s “ Meet the Press.” Nancy Pelosi, who was then the House speaker, “was in charge of security. She turned down 10,000 soldiers. If she didn’t turn down the soldiers, you wouldn’t have had January 6th.”
He dismissed claims that the National Guard offer was never officially made to Ms. Pelosi.
“The mayor of D.C. gave us a letter, saying that she turns it down, OK? We have it. Nancy Pelosi also was asked, and she turned it down,” he said, adding that the police commissioner of the Capitol Police said that he wanted the troops. "And Nancy Pelosi wouldn’t accept it. … Nancy Pelosi is responsible. And the J6 Committee refused to interview her.”
When interviewer Kristen Welker asked why President Trump did not “send help in that moment” during the Capitol breach, he replied, “I assumed that [Pelosi] took care of it.”
“I understand that the police testified against her—the chief, very strongly against her. Capitol Police, they’re great people. They testified against her.”

ANALYSIS: Disappearance of Chinese Defense Minister Points to CCP Turmoil
|
|
The mysterious disappearance of China’s defense chief just months after he ascended to the post is fueling questions about his fate and the stability of the Chinese Communist Party.
Li Shangfu, who was handpicked by Chinese leader Xi Jinping for the role in March, has been missing from public view for more than two weeks; his last appearance was on Aug. 29, when he delivered a keynote address to African defense officials at a security forum in Beijing.
A stream of reports citing sources in China and U.S. officials suggest that Mr. Li has been stripped of his responsibilities and is possibly under investigation for corruption, which would make him the fourth senior Chinese official falling from grace less than a year into Mr. Xi’s third term.
The unexplained absence, after Mr. Li unexpectedly pulled out of a meeting with Vietnamese counterparts in recent weeks, follows a pattern amid the summer of abrupt reshuffling that shook the top echelons of Chinese communist leadership, among them the surprise ouster of former Foreign Minister Qin Gang.
Also a Xi protégé, Mr. Qin vanished from the public eye for a month after holding the role for seven months. With no explanation, his predecessor, Wang Yi, took over the post in July, while Mr. Qin's records briefly disappeared from the Foreign Ministry website. (The Epoch Times) Read more here.

‘Disturbing’ and ‘Inarticulate’: Pro-Life Leaders React to Trump’s Abortion Comments

Pro-life advocates have called Republican presidential front runner Donald Trump’s comments “disturbing” after the 45th president said he will “bring peace” on abortion by negotiating a plan that pleases “both” abortion foes and activists — and attacked some of his rivals’ more comprehensive protections for life.
“I would sit down with both sides, and I’d negotiate something, and we’ll end up with peace on that issue for the first time in 52 years,” President Trump told Kristen Welker on “Meet the Press” Sunday. When asked directly whether he will sign national legislation protecting unborn children from abortion beginning at 15 weeks, he replied, “I’m not going to say I would or I wouldn’t.”
The president portrayed himself as a chief negotiator between pro-life advocates and abortion activists, taking neither position firmly. “I’m almost like a mediator in this case,” he told Welker, who just replaced Chuck Todd as host of the ailing show. When all is said and done, Trump said, “I think both sides are going to like me.”
Pro-life leaders found the president’s comments concerning. “We’re at a moment where we need a human rights advocate, someone who is dedicated to saving the lives of children and serving mothers in need. Every single candidate should be clear on how they plan to do that,” Marjorie Dannenfelser, president of SBA Pro-Life America, told The Washington Stand exclusively. “It begins with focusing on the extremes of the other side — and ambition and common sense on our own.”
“Quite frankly, it was a bit troubling,” said Tony Perkins, chairman of summit sponsor FRC Action, on “ Washington Watch” Monday.
The right-to-life movement also took exception when Trump targeted those to his right on the issue of abortion, especially his most successful Republican challenger, Florida Governor Ron DeSantis. DeSantis, he noted, was “willing to sign a … six-week ban.” Just moments before Trump’s speech at the Pray Vote Stand Summit, DeSantis boasted of “enacting the strongest pro-life protections in the modern history of Florida: The Heartbeat Protection Act.”

1. Netanyahu, Erdogan begin sit-down on UN sidelines, their first-ever meeting - Times of Israel
NEW YORK — Prime Minister Benjamin Netanyahu meets Turkey’s President Recep Tayyip Erdogan on the sidelines of the UN General Assembly in New York,
This is the first meeting between the Turkish leader and any Israeli premier since 2008. It is also Netanyahu’s first meeting with Erdogan.
The meeting is taking place at the Turkish House across from UN Headquarters.
Netanyahu was scheduled to visit in July but postponed the trip after having a pacemaker put in. (Read more)

2. Zelensky tells Netanyahu he 'expects a lot' from Israel - Jerusalem Post
Expecting “a lot” Ukrainian President Volodymyr Zelensky sat down to talk with Prime Minister Benjamin Netanyahu on Tuesday afternoon in a basement conference room at the United Nations.
It’s the first face-to-face conversation between the two men since Netanyahu returned to office at the end of December.
Zelensky had wanted their first meeting to be in Ukraine. Netanyahu has not joined Western leaders in visiting Kyiv in a show of solidarity, taking a more cautious approach to Russia’s invasion of that country out of concern for angering Moscow. (Read more)

3. Saudi FM pushes for two-state solution to Israeli-Palestinian conflict - World Israel News
Following reports that Saudi Arabia suspended normalization talks with Israel over concerns that Jerusalem won’t grant sweeping concessions to the Palestinians, the Gulf Kingdom’s Foreign Minister called for the formation of an independent Palestinian state.
“The two-state solution must return to the forefront,” Saudi Foreign Minister Prince Faisal bin Farhan Al Saud told Al Arabiya TV on Monday.
‘The solution to the Palestinian issue supports the stability of the region and the world,” he added.
Prince Faisal also noted that “we now see a continuing escalation in the occupied territories,” in what appeared to be a reference to a spate of Palestinian terror attacks launched against Israeli soldiers and civilians. (Read more)

i24 News — The Israel Defense Forces (IDF) and the Israeli Defense Ministry revealed on Tuesday its next-generation Merkava Mark 5 tank, nicknamed “Barak” [Hebrew for lightning], for the first time.
“The innovative era that brings with it the Barak tank to the IDF is an exceptional leap forward and a clear expression of the IDF’s technological abilities which time and again guarantee its qualitative advantage,” Israeli Defense Minister Yoav Gallant said in a statement.
After news broke last year of the Merkava Mark 5 entry into service, the IDF and Defense Ministry jointly announced the in-depth details of Israel’s new “Barak” and confirmed its high-tech capabilities.
The Merkava Mark 5 is equipped with the latest technology, including AI, which would reportedly boost the tank’s lethality and ability to generate intelligence reports for both itself and other forces. (Read more)

5. Israel Dog Unit aprehends illegal infiltrators in central Israel - Israel National News
The Israel Dog Unit (IDU), a nonprofit specializing in security dogs, today conducted a special operation to deter and apprehend illegal infiltrators from the Palestinian Authority in the city of Tzur Yitzhak in central Israel. The operation included forces from the ISA, IDF, Israel Police, and the civilian security team of Tzur Yitzhak.
During the operation, several suspects were detained, including a group attempting to enter via gaps in the city's security fence and others attempting to enter with false identification or work permits.
IDU volunteers used working dogs and advanced drones to locate and apprehend the suspects, transported suspects for further questioning by security forces and gathered intelligence on the routes used by illegal infiltrators to circumvent the city's security mechanisms. (Read more)

Ray Epps, a former Oath Keeper member who became the target of Jan. 6 conspiracy theories spread by many Republicans, has been charged in connection with the attacks at the U.S. Capitol.
The Justice Department charged Epps on Monday with a single misdemeanor count of disorderly and disruptive conduct in a restricted area via a criminal information, which is often an indication a defendant is prepared to plead guilty.
Epps' attorney, Edward Ungvarsky told ABC News he anticipates a guilty plea to the charge. Epps said he went to D.C. on Jan. 6, 2021, to protest the 2020 election. Republicans accused him of being an undercover federal agent that urged supporters of former President Donald Trump to storm the U.S. Capitol on Jan. 6, 2021. (Read more)

2. Half the nation’s governors fire off letter to Biden on migrant crisis as numbers surge - DML News
More than two dozen governors are calling on President Biden to provide “honest, accurate, detailed information” about the ongoing migrant crisis at the southern border, including where migrants are moving to and data on removals and asylum claims — as they warn that states are facing “staggering” costs related to the crisis.
“As a result of your policies which incentivize illegal immigration, our states are carrying the burden of both the years-long surge in illegal border crossings and cartels’ coordinated trafficking of drugs and human beings,” the 25 governors led by Montana Gov. Greg Gianforte, say in a letter to Biden.
“States are on the front lines, working around-the clock responding to the effects of this crisis: shelters are full, food pantries empty, law enforcement strained, and aid workers exhausted,” they say. “As governors, we call on you to provide honest, accurate, detailed information on where the migrants admitted at the southern border are being relocated in the United States, in addition to comprehensive data on asylum claim timelines and qualification rates, and successful deportations.” (Read more)

3. Battleground Pennsylvania ushers in automatic voter registration ahead of 2024 - Washington Examiner
Gov. Josh Shapiro's (D-PA) office announced on Tuesday that Pennsylvania is rolling out automatic voter registration ahead of what promises to be a close 2024 matchup in the battleground state.
Shapiro, who has emerged as a popular figure in the state, said the move would be beneficial for democracy.
“Automatic voter registration is a commonsense step to ensure election security and save Pennsylvanians time and tax dollars,” the governor said in a statement. “Residents of our Commonwealth already provide proof of identity, residency, age, and citizenship at the DMV — all the information required to register to vote — so it makes good sense to streamline that process with voter registration.”
When citizens go to obtain or renew their motor vehicle licenses, they will need to opt out of voter registration if they wish not to be registered. (Read more)

4. Report reveals where Trump will be during second GOP presidential debate - DML News
Former President Donald Trump will be skipping the second GOP primary presidential debate, according to a report by the New York Times. The second debate, scheduled for September 27, will be held at the Ronald Reagan Presidential Library in California and hosted by Fox Business. However, while Trump’s challengers are debating on stage, he will be speaking with a group of 500 auto workers – again, timed to coincide with the GOP debate.

Former President Donald J. Trump is planning to travel to Detroit on the day of the next Republican primary debate, according to two Trump advisers with knowledge of the plans, injecting himself into the labor dispute between striking autoworkers and the nation’s leading auto manufacturers.
The trip, which will include a prime-time speech before current and former union members, is the second consecutive primary debate that Mr. Trump is skipping to instead hold his own counterprogramming. He sat for an interview with the former Fox News host Tucker Carlson that posted online during the first G.O.P. presidential debate in August. (Read more)

5. Biden admin unleashes 50-year mining, oil drilling ban across thousands of acres in New Mexico - Fox News
The Biden administration proposed to block off thousands of acres from future oil drilling or mining in northern New Mexico in an effort to protect Native American lands. According to the Department of the Interior (DOI), the proposal would ban new mining claims and oil and gas development across more than 4,200 acres in Sandoval County, New Mexico, located north of Albuquerque.
If finalized and implemented, the action would remain in place for up to 50 years.
"Today we’re responding to call from Tribes, elected leaders, and community members who want to see these public lands protected," Interior Secretary Deb Haaland said in a statement. "We look forward to hearing more from the public to inform decisions about how activities, like gravel mining, may impact these lands, including the important cultural and natural resources." 6. Nolte: Democrat-Run California Predicted to Lose Five House Seats by 2030 - Breitbart
This news comes from Decision Desk HQ, which looked at the data and concluded, “If current trends continue, the state could lose as many as five congressional districts in the 2030 reapportionment cycle.” Now you know one of the many reasons Democrats are flooding America with illegals and want to make them citizens.
Currently, California is the biggest state in the union, with 52 congressional districts. Only twelve of those districts are Republican seats. The remaining 40 are Democrat seats. Both of the (formerly) Golden State’s Senate seats are held by Democrats.
Obviously, California has a big impact on which party holds the U.S. House of Representatives. (Read more)

7. Masks Return: Some U.S. Hospitals Reinstate Mask Policies - Brietbart
Some hospitals and hospital systems across the country are reinstating mask policies well over three years after the start of the coronavirus pandemic.
Major mask mandates that dominated the country for months on end — including the controversial mask mandate for air travel, which the courts struck down — have come and gone. However, some entities, including schools and some workplaces, have brought them back, at least on a short-term basis, citing rising cases of the coronavirus.
Massachusetts’ Baystate Health is among those bringing back masking, requiring those entering patient rooms or care areas to wear a mask.
Dr. Andrew Artenstein, Baystate Health’s chief physician executive and chief academic officer, said the hospital system opted to make this decision because of an increase in coronavirus cases. He believes this move will “protect the safety and health of [their] patients, visitors, and employees.” (Read more)

8. Debris reportedly found in South Carolina after F-35 stealth fighter jet disappearance; USMC pauses air ops - Fox News
A debris field has been located by military officials amid their investigation of the F-35 jet that disappeared in South Carolina on Sunday.
Joint Base Charleston told Fox News Digital that the debris field was found in Williamsburg County, South Carolina. Officials did not confirm that the debris was from the missing aircraft.
A pilot ejected from the aircraft on Sunday afternoon after a "mishap." The jet was a Lockheed Martin F-35 Lightning II that belonged to Marine Corps Air Station Beaufort. The pilot landed on the ground safely and was treated at a local medical center. (Read more)

9. China flies more than 150 military planes toward Taiwan as island condemns military ‘harassment’ - Fox News
China’s military sent over 150 warplanes toward Taiwan this week in an unprecedented military action that the island’s government swiftly condemned as "harassment."
On Monday, mainland China’s military, known formally as the People’s Liberation Army, flew 103 warplanes near and over the island in a 24-hour period in what the island’s defense ministry called a recent new high. On Tuesday, an additional 55 PLA aircraft were detected near the island by Taiwan’s R.O.C. Armed Forces.
The Ministry of National Defense said 40 of the planes invaded Taiwan’s Air Defense Identification Zone, the symbolic median line between mainland China and the island. They included more than 30 fighter jets as well as midair refueling tanker planes. Another 27 of the warplanes on Tuesday crossed the ADIZ.
"We urge the Beijing authorities to bear responsibility and immediately stop such kind of destructive military activities," Taiwan’s Defense Ministry said in a statement, calling the Chinese military action "harassment" that could escalate in the current tense atmosphere. (Read more)

The Democrats in Congress and those appointed to the Judiciary have made a very strong point about the January 6, 2021 convergence on the US Capitol: anyone associated with entering the Capitol on that day is an insurrectionist and should be treated with the harshest punishment. The Democrats and some Republicans are going after the golden ring of the Jan 6 “rebellion,” their alleged ringmaster President Donald Trump. Americans have witnessed how the Democrat-led trials have withheld video footage, edited footage, selected testimony and created their narrative about the threat these protesters posed to their form of democracy. But the question still remains: Who was responsible? What is the truth?
A very calm Nancy Pelosi (D-CA) was in her Capitol Hill office on January 6, 2021 observing President Donald Trump’s speech and watching protesters gather by the capitol. Her daughter Alexandra was filming her. We know this because the video aired for the first time October 13 on CNN’s Anderson Cooper 360. Pelosi, wearing a COVID mask is seen saying: “It’s very dangerous what he’s doing. He’s getting all these people to show up and protest “stop the steal.” He’s putting all these crazy ideas in their heads…Tell him if he comes here, we’re going to the White House (laughing)…” Two staffers in masks report to Pelosi that Secret Service dissuaded Trump from coming to the Capitol. House Republicans Reportedly Set Date for First Biden Impeachment Inquiry Hearing

House Republicans have scheduled the first hearing in their impeachment inquiry of President Joe Biden, according to Fox News. The outlet said it had learned from unidentified sources familiar with the matter that the hearing is set for Sept. 28.
House Speaker Kevin McCarthy announced the impeachment inquiry on Sept. 12, saying House investigators have found a “culture of corruption” surrounding Biden and his family, particularly son Hunter Biden.
Republicans, including McCarthy, have been tight-lipped about their plans for Biden’s impeachment.
According to Fox News, GOP leaders hope the inquiry, wherever it might lead, will be wrapped up before the 2024 primary voting begins.
McCarthy has been clear that he believes there is ample evidence to warrant the inquiry and potentially a vote to impeach the president. “I am directing our House committee to open a formal impeachment inquiry into President Joe Biden,” McCarthy said at a news conference Sept. 12.
“This logical next step will give our committees the full power to gather all the facts and answers for the American public,” the speaker said. (Western Journal) Read more here.

At the Terezin concentration camp, some of Europe’s top artists found solace in creating new work. Today one musician is determined to give them an encore
In 1988, Mark Ludwig, a tenured violist with the Boston Symphony Orchestra, was between events at New York City’s Carnegie Hall when he wandered into his favorite used bookshop. He picked up a biography of Leo Baeck, the 20th-century German rabbi and scholar. Baeck had been imprisoned during World War II at the Terezin concentration camp in Czechoslovakia. He’d survived, settled in London and become one of the foremost theologians of his day. Something in the book caught Ludwig’s attention—Baeck’s observation that despite the hardship and cruelty of the camp, inmates produced an impressive output of high-quality classical music.
Ludwig had heard of Terezin: The Nazis had established it as a way station to the notorious extermination camps such as Auschwitz. He knew that famous artists and musicians had been incarcerated there. He had seen I Never Saw Another Butterfly, a book of the children’s art created in secret classes at the camp. But he was not aware of the musical compositions. So the next time he was in Europe, he went to an archive in Prague, where the director handed him some sheet music written by one of the inmates. Israel Pro-Life Leaders, Lay People to Gather at First National Prayer Event for Unborn During ‘Ten Days of Awe’

JERUSALEM, Israel – Pro-life leaders in Israel will hold a first-ever "National Prayer for Life" event in central Israel this Friday during the "Ten Days of Awe" between the Jewish Feast of Trumpets holiday and the Day of Atonement, Yom Kippur, which begins Sunday evening. It's estimated that 1 in every 5 pregnancies in Israel ends in abortion, and that prompted Messianic and Evangelical Jewish leaders to call pastors and lay people to central Israel for a collective act of repentance and petition on behalf of the nation for abortion, which was legalized in 1977, but has been practiced since the founding of the modern state. Sandy Shoshani, the director of Be'ad Chaim in Jerusalem, one of the few pro-life groups in the country, was one of the event's chief organizers. She told All Israel News that the Ten Days of Awe is an important time to bring the matter before the Lord. “We urge the Body of Messiah to stand with us in the gap for the unborn during these next 10 days," she said.
Shoshani added, “We repent for the shedding of the innocent blood of two million babies in the Land of Israel since its establishment as a State. We beseech the God of Heaven to protect these vulnerable little ones. We pray for restoration for all those who suffer guilt and shame as a result of abortions. And we ask the Lord to rescue those who are being led away to death, and save those who stumble toward slaughter.” Organizers have also produced a prayer guide for the 10 days, suggesting scriptures and areas for prayer. Event leaders hope to enlist support from both Jewish and Arab congregations in the land.
