Supreme Court Rules Against Norfolk Southern Railway in Pennsylvania Case
|
|
In a fractured ruling that may invite a future constitutional challenge, the U.S. Supreme Court upheld by 5–4 a unique Pennsylvania law that requires companies to face litigants in its state courts when they register to do business in the state.
Pennsylvania is reportedly the only state with this kind of law.
The court vacated the judgment of the Supreme Court of Pennsylvania and remanded the case to that court, directing it to take a second look at a lawsuit a former Norfolk Southern Railway Co. employee brought against the company in a state where it isn’t based.
Justice Neil Gorsuch wrote the opinion (pdf) of the U.S. Supreme Court in Mallory v. Norfolk Southern Railway Co. (court file 21-1168).
Robert Mallory worked for Norfolk Southern as a freight car mechanic for almost 20 years, first in Ohio, then in Virginia. During his time with the company, he was responsible for spraying boxcar pipes with asbestos and handling chemicals in the railroad’s paint shop, he said. He also demolished car interiors that, he claimed, contained carcinogens, according to a court summary.
After Mr. Mallory left the company, he moved to Pennsylvania for a time before returning to Virginia. Along the way, he was diagnosed with cancer, which he blamed the company for. He hired lawyers in Pennsylvania to sue his former employer in Pennsylvania state court under the Federal Employers’ Liability Act. The statute created a workers’ compensation system allowing railroad employees to recover damages for employers’ negligence.
Norfolk Southern resisted the lawsuit on constitutional grounds. By the time he filed his complaint, the company noted, Mr. Mallory lived in Virginia. His complaint alleged that he was exposed to carcinogens in Ohio and Virginia. Meanwhile, the company itself was incorporated in Virginia and had its headquarters there.
The company argued this meant that any effort by a Pennsylvania court to exercise personal jurisdiction over it would offend the due process clause of the 14th Amendment to the U.S. Constitution. (The Epoch Times) Read more here

Abba, thank you that the Supreme Court made the Norfolk Southern Railroad live within the boundaries of the agreement they committed to when starting to do business in Pennsylvania. We ask that every person who worked for Norfolk Southern in job functions that exposed them to carcinogenic substances leading to cancer or any other disease, be compensated for all expenses derived from these toxic chemicals.
We ask for this decision to bring hope to those who are or were sick but couldn't see a path to get help before now. Father God, you are the God who sees, you know each and every person. We ask for restored hope, new vision and the peace that passes all understanding for each person and those who have stood with them and cared for them. UK vows to ‘lead international opposition’ to Iran as head of UN Security Council
|
|
In the first week of its presidency of the UN Security Council, the United Kingdom took an aggressive stance toward Iran, announcing Thursday a raft of new sanctions over human rights abuses and expanding existing penalties by imposing further criteria under which individuals and entities can be hit.
The new sanctions by the Foreign Office apply to 13 individuals and entities allegedly involved in torture in prisons, surveillance of regime opponents, and repression of women. They come on top of over 350 UK sanctions already in place.
The UK will also “lead international opposition to Iran’s weapons proliferation and nuclear escalation” at the Security Council, the ministry said, adding that it plans to denounce Tehran’s behavior at Thursday’s meeting, which will be attended by Iran’s ambassador to the UN. US has military options for Iran's nuclear threat, CENTCOM air force chief tells 'Post'

Top official discusses regional missile defense, the threat from Iran, and US-Israel ups and downs.

The US regularly updates its military options for threats from Iran’s evolving nuclear facilities, US Lt. Gen. and CENTCOM Air Force Chief Alexus Grynkewich told The Jerusalem Post in an exclusive interview.
Israel also seeks regularly to gauge how much of a threat Iran’s nuclear program presents and how much backing Jerusalem would have from the US if it needed to confront that threat with preemptive strikes. The Post asked the AFCENT chief whether the US military would continue to be able to potentially handle the threat from the Islamic Republic of Iran, despite the construction of a new, deep, underground nuclear facility at Natanz.
“You can assume we are keeping a very close eye on Iranian facilities out there, continuing our evaluation of what it means, what Iran is using it for, what options we might have for those facilities,” Grynkewich said. (Jerusalem Post) Read more here.

1. IDF strikes missile launch site in Lebanon - JNS
The Israeli military carried out strikes against a missile launch site in Lebanon on Thursday.
IDF soldiers arrived near the border town of Ghajar after reports of an explosion in the area. They learned that an anti-tank, guided missile fired from Lebanese territory exploded next to the border in Israeli territory.
Arab channels said Palestinian factions, angered by this week’s IDF operation in Jenin, fired the projectile. No one immediately claimed responsibility.
“Against any violation of our sovereignty and challenge to our presence in our country, we will respond at the place and time of our choosing, in overt and covert ways, that will exact a clear price from those responsible,” said Defense Minister Yoav Gallant at an event in the north. (Read more)

2. Driver rams protesters on Ayalon highway as protests spread across country - Jerusalem Post
A man driving a grey BMW on the Ayalon highway drove through a group of protesters on Wednesday evening as spontaneous demonstrations erupted across the country after Tel Aviv police district commander Ami Eshedannounced his resignation, according to police.
The driver was promptly apprehended and no injuries were reported at the scene.
Thousands of Israelis took to the streets on Wednesday evening following Eshed's announcement that he would step down from his position due to what he called a series of politically-targeted moves against him. (Read more)

3. Soldier Murdered in Terror Attack Near Kedumim - Jewish Press
A terrorist opened fire on IDF soldiers near Kedumim critically wounding one of the Israelis on Thursday afternoon at approximately 3:30 PM. The soldiers had noticed a suspicious vehicle and stopped it. The terrorist driver then opened fire critically wounding a soldier. The soldiers returned fire, but the terrorist escaped. The soldier was declared dead at the scene.
IDF and civilian security forces then chased after the terrorist and shot and killed him.
The IDF now believes the terrorist had planned to infiltrate into Kedumim to commit his terror attack inside the town.
Released for publication: The soldier who was killed has been identified as First Sergeant Shilo Yosef Amir, age 22, from the town of Meirav. He served in Sayeret Givati. He leaves behind his parents and four brothers. He will be buried on Friday on Mount Herzl military cemetery in Jerusalem. (Read more)

4. Cabinet to discuss relief measures for PA - Israel National News
The Political-Security Cabinet will convene on Sunday to discuss relief measures for the Palestinian Authority, Kan 11 News reported on Thursday.
According to the report, the defense establishment has in recent days recommended to Prime Minister Benjamin Netanyahu to take steps to strengthen the Palestinian Authority. This is partly in the wake of the PA's deteriorating situation.
The issue came up in a discussion with the Prime Minister at the beginning of the week, even before the operation in Jenin, and staff work is currently underway to formulate recommendations for relief measures for the Palestinian Authority.
The Cabinet discussion was initially planned to take place only in about ten days, but in the wake of recent tensions, it was decided to hold it earlier. (Read more)

5. BBC apologizes after anchor says 'Israeli forces are happy to kill children' - Jerusalem Post
The BBC issued an apology on Wednesday following a contentious interview in which a presenter made controversial remarks suggesting that "Israeli forces are happy to kill children," according to the Jewish Chronicle.
Anjana Gadgil, the news presenter, made these comments while discussing Israel's military operation in Jenin with former-Israeli Prime Minister Naftali Bennet, during a Tuesday evening broadcast.
After facing pressure from Jewish community groups, who accused the BBC of partiality and displaying anti-Israel bias, the corporation offered an apology.
During the interviews, Gadgil asked Bennet about the young casualties of the military operation, stating, "The Israeli military is calling this a 'military operation,' but we now know that young people are being killed, four of them under eighteen. Is that really what the military set out to do? To kill people between the ages of 16 and 18?" (Read more)

1. Taking Stock of Bidenomics – ZeroHedge
Speaking in Chicago last week, President Joe Biden made one of the early speeches of his 2024 reelection campaign. Mindful that the state of the economy is a primary concern of American voters in every presidential election, Mr. Biden trumpeted the alleged successes of his policies. In his words,“Bidenomics, we’re turning this around. We’re supporting targeted investments. We’re strengthening America’s economic security, our national security, energy security, and our climate security.”
Americans can be forgiven for feeling that they aren’t as economically secure as Mr. Biden claims. During the 29 months of the Biden presidency, real earnings for the average worker have fallen by 3.16 percent. An eroding standard of living doesn’t make people feel secure. Certainly, Bidenomics has made a mess of the automotive industry. Tens of thousands of autoworkers are being laid off and companies are sustaining losses as a consequence of their ill-advised government-subsidized shift into electric vehicles. Just as his former superior, Barack Obama, wasted billions of taxpayer dollars on green fiascoes and boondoggles, Mr. Biden is doubling down on the same failed strategy. (Read more)

2. Don’t Look Now, but Utter Chaos is Being Unleashed All Over the World – The Economic Collapse blog
The relative peace and tranquility that we had been enjoying for several months has been shattered. All of a sudden, chaos is erupting all over the globe. Much more civil unrest and war are ahead, and that has very serious implications for every man, woman and child on the entire planet.
Personally, I have been absolutely stunned by the tremendous violence that has been taking place in France. It is being reported that 5,662 vehicles
have been set on fire during the rioting so far…
Ministry of the Interior figures taking account of damage to people and property during the now six nights of riots triggered by the shooting death by a police officer of an Algerian heritage teenager in a Paris suburb at a traffic stop reveals there have been 5,662 vehicle fires so far, reports Le Parisien.
The widespread destruction of vehicles, which as images recorded in the areas of unrest in France attest, include not just private cars but also trucks and buses. Trams have also been targeted by vandals. In one widely-reported case, a large truck was stolen by looters to ram down the doors of a mall to gain access to the merchandise inside. There were 1,919 vehicle fires on Thursday night alone.
France has seen a lot of riots in recent years, but nothing quite like this. At least 1,000 buildings have been torched during these riots, and that includes 254 police stations… (Read more)

3. Meta Launches Twitter Clone, “Threads”, Immediately Starts Censoring – ZeroHedge
Meta claims that over 10 million people had signed up for it's Twitter competitor, Threads, in what CEO Mark Zuckerberg framed as a "friendly" alternative to the little blue bird. Meanwhile, data privacy and censorship concerns have emerged, with former Twitter owner Jack Dorsey highlighting the vast amount of data collected by Threads.
As journalist Michael Shellenberger notes, within a few hours of launching, Threads was already secretly censoring users and not offering them the right to appeal.
Meta is already too powerful. One company controls what much of the public is allowed to see. And if Threads succeeds, it will have 80% of the global market outside of Russia and China, according to one industry insider. As such, it’s reasonable to expect that Meta will censor precisely the same way the large news media corporations, including the New York Times, and corporate advertisers want it to. More censorship is what the mainstream news media, big corporations, and their celebrity pitch people have been demanding. ...additionally, Unlike Twitter, Threads collects data about "Health & Fitness," "Financial Info," "Sensitive Info," and "Other Data.”

5. Google Pulls Sponsorship of LGBT “Pride and Drag” Show Mocking Christ After Backlash From Employees – LifeSite News
Google was supporting a 'direct affront to the religion beliefs and sensitivities of Christians,' according to an employee petition.
In a rare instance of acquiescing to “anti-woke” backlash, far-left internet giant Google dropped its association with a San Francisco drag event after a group of employees expressed their objections.
that among multiple pro-LGBT events Google sponsored to commemorate June “Pride Month” this year was a “Pride and Drag Show” to “wrap up this amazing month” at the San Francisco homosexual bar Beaux. This particular show featured drag performer Joshua Grannell, better known by the stage name “Peaches Christ.”
A “few hundred” Google employees signed a petition against the company’s sponsorship of the event, which they claimed was “provocative and inflammatory artistry” that constituted a “direct affront to the religion beliefs and sensitivities of Christians,” on top of violating the company’s guidelines against events featuring sexually explicit activity. Google later withdrew its sponsorship of the event and replaced it with a gathering at Google’s own offices. (Read more) |

6. COVID Racket: Biden Stole 1 Billion from US Taxpayers by Overpaying for Chinese COVID Test kits – Pandemic news
All the controversy about what Joe Biden and his crime family received in the form of illegal cash payments during his vice presidency under Barack Hussein Obama is just a drop in the bucket compared to what Biden and his cronies stole in order to purchase Chinese-made covid “test” kits.
Estimates range from $900 million to $1.1 billion as to the amount of money Biden stole from United States taxpayers in order to buy pallets upon pallets of Wuhan coronavirus (Covid-19) test kits.Reports indicate that Biden and his cronies paid $1 per test kit for 100,000 kits at a time. We know, however, that only 400 million covid test kits were purchased by the regime, the first batch being 300 million followed by an additional 100 million.
Simple math shows that at $1 a pop, this should have costed Americans no more than $400 million, as the more one buys of something the cheaper it gets per unit due to bulk discounts. So, what happened to the other $600 million that the Biden allegedly forked over to communist China for these test kits? (Read more)

7. Macron Deploys 45,000 French Police to Tackle Torching of Infrastructure, Vehicles, Public Spaces in Ongoing Nationwide Riots – NewsTarget
French President Emmanuel Marcon deployed some 45,000 police on Sunday, July 2, a day after Nahel Merzouk was laid to rest in the Paris suburb of Nanterre, to deal with the ongoing nationwide riots. Merzouk, 17, was shot dead by police during a traffic stop on June 27. Out of the total number, 7,000 were stationed in the France capital and its suburbs, including the streets of top tourist destinations such as Champs Elysees in central Paris as the police monitored calls on social media to take rioting to the heart of "La Ville Lumiere."
The same number was also positioned the night before, and backup was dispatched to the previous days' flashpoints, including Lyon, Grenoble and Marseille. Reports indicate that more than 700 people were arrested following the funeral on Saturday as police fired tear gas and fought street battles with protestors late into the night in Marseilles, a hot spot for the uprising. 8. White Hat Hacker Dismantles World’s Largest Pedophile Ring, Sends Child Rapists to Prison – NewsTarget
A "white hat" or ethical hacker has used his skills for good by taking down the world's biggest online pedophile ring and contributing to the imprisonment of a serial child sexual abuser.Twenty-nine-year-old Ryan Montgomery of Pennsylvania – also known by his nickname "0day" – decided to start helping authorities dismantle child abuse networks after receiving a text message from a distressed friend three years ago. The message spoke of a website for pedophiles "sharing videos of little girls" and " talking about how they raped and abused children." The website's link was included in the message, alongside a screenshot of three children in bathing suits. The description urged users to "pick one" for themselves, with one casting his bets on the one in the middle. Horrifying images, videos and paragraphs were also found on the website.Montgomery sprung into action and utilized his skills to infiltrate the website. He managed to extract data en masse – including usernames, incriminating threads and descriptions of acts beyond the pale. While he obtained a stockpile of evidence from the site, he did not lift photos due to their illicit nature.
The white hat hacker then reached out to the National Center for Missing and Exploited Children's child pornography cyber tip line and sent over the damning database. While he never heard back from the nonprofit after he sent his tip, Montgomery said arrests were made following his actions. (Read more)

REYKJAVIK, Iceland – Residents on the Nordic island nation of Iceland are closely watching a volcano that has been the focal point of thousands of earthquakes over the last few days, which could signal an upcoming eruption. The Icelandic Meteorological Office reports more than 4,700 earthquakes have occurred around Mount Fagradalsfjall – an active volcano about an hour’s drive from the capital city of Reykjavík.
Most earthquakes have been minor, but government agencies warn that seismic activity has increased the risk of landslides. Alert statuses around the volcano have been raised in anticipation of increased activity and volcanic ash. The volcano produced a series of eruption events in 2021 and 2022 but has been mostly quiet for nearly a year.
"Based on the present assessment, two outcomes are possible. The seismicity could decrease progressively without magma reaching the surface. Alternatively, the seismicity could still decrease when the magma stops moving laterally but begins to move upward towards the surface (as observed prior to the last two eruptions here). This would likely result in an eruption close to where seismicity is currently concentrated. However, magma reaching the surface anywhere in the region between Fagradalsfjall and Keilir cannot be excluded. Of the two possible outcomes, a volcanic eruption occurring within days or weeks is considered more likely," meteorologists stated during their latest volcanic update.
The volcano is located far enough away from many of the country’s 375,000 residents that impacts are usually minor during times of eruptions. Fagradalsfjall is only about a 20-mile drive from the country’s main airport of Keflavík, which has previously triggered concerns in the aviation community. Planes are highly susceptible to ash, and the U.S. Geological Survey reports there have been at least 79 cases worldwide of volcanic material damaging aircraft since the 1950s. (Read more)

We do pray that the earthquakes would decrease and the likelihood of a volcanic eruption in Iceland at this time would subside. May the government and citizens be alert and have Your wisdom and timing to avoid harm. We pray also that air travel would not be canceled or diverted. Your will to be done, Your will only, that Your plans and purposes will be accomplished.
Almighty God, we can see Your power and majesty as we witness quakes and volcanos throughout the world. It is written that in the last days there will be an increasing number of shakings in the lead-up to Your return. May multitudes see the powerful and violent natural and supernatural phenomena that You permit and look to You for salvation and redemption. In wrath, Lord, remember mercy. In Yeshua’s name, Amen!

Christians and conservatives get riled up pretty easy over the deliberate weaponization of the news, the falsehoods, half-truths, lies, insinuations, agenda pushing and just plain political intolerance and ideological bigotry by the news media and the liberals. We are living in a nation where the meanest, most outrageous, and inaccurate things can be said about people and there is little to no accountability. Willful ignorance amongst the population then spreads this terrible misinformation throughout the internet, and the stories get bigger and lore grows greater and soon the lie becomes the fact as it is repeated. But it is not only the liberal media, Democrats and leftist Hollywood elites who are guilty of this.
My mother always told me, “If you don’t have anything nice to say, don’t say anything at all.” I didn’t realize it at the time, but Mom was being very biblical. Leviticus discusses a leprosy-like condition called tzara’at. Further study reveals that those who spoke evil of another would break out in tzara’at. They had to go to the priest for repentance and healing. Called lashon hara, meaning “evil tongue,” speaking evil of someone, slandering them, libeling them, passing gossip, were all forbidden by the Lord God. Moses, when he told God that the people wouldn’t believe that God had sent him, turned white with tzara’at for speaking evil about God’s people. INSTRUCTIONS TO "BURY THE HATCHET!"

Blessings my friends,
I am writing today to explain a prayer initiative that began with three dreams I have encountered. This is an assignment for my co-laborers & patriots of prayer to assist in. In these dreams there is instruction for an initiative that will facilitate a further healing of our land, the United States of America, from the trauma it has experienced. The third dream expresses how to facilitate people, through their obedience, to be healed of the trauma they have experienced through disappointment, betrayal and loss of hope.

Here are the dreams.
I dreamed on three occasions in 2020, with the last dream occurring in October. In the dreams, Jesus came and spoke to me that what was taking place in our Nation had brought great trauma into the land. Jesus instructed me in the dream that time was coming for me to start an initiative that would bring healing in the land. He spoke about how in the past some of the First Nation people would gather and bury two hatchets at the base of an evergreen tree to bring peace and heal the conflicts between the tribes. The evergreen tree represents covenant. The hatchets (or axes) represent weapons of war in the natural. Covenant is a major aspect of healing our land. Jane Hamon recently prophesied that “2021 would be a year of conflict and contending.” Our “contending” comes from the foundation of “covenant.”

The third and final dream was slightly different in that Jesus instructed that this prophetic act would require people’s participation to help heal the trauma that people have experienced. He instructed me to facilitate people of every state to participate in the healing of their land, state and people.
After months of prayer and counsel, I know it is time to initiate this mandate. Will you please pray and join with the Praying Church, the standing Ekklesia and Body of Christ, to take this “one small step for a man” to bring a Kingdom Leap Forward for our Nation?
We are asking those who participate in this Heal our Land Initiative to memorialize their prophetic act of burying the hatchet by emailing a testimony of their experiences to us. We will post the testimonies on my website by State so others can read and receive hope and faith. The testimonies will serve to stir others to follow their lead.

Greene Won’t Confirm or Deny Rumors of Her Removal From House Freedom Caucus

Rep. Marjorie Taylor Greene (R-Ga.) has refused to say whether rumors that she was booted from the House Freedom Caucus are true.
In a statement to The Epoch Times, Ms. Greene, who has represented Georgia’s 14th Congressional District since 2021, did not confirm or deny she was kicked out of the right-wing group.
“In Congress, I serve Northwest Georgia first, and serve no group in Washington,” she said. “My America First credentials, guided by my Christian faith, are forged in steel, seared into my character, and will never change,” she continued. “I fight every single day in the halls of Congress against the hate-America Democrats, who are trying to destroy this country.
“I will work with anyone who wants to secure our border, protect our children inside the womb and after they are born, end the forever foreign wars, and do the work to save this country. The GOP has less than two years to show America what a strong, unified Republican-led Congress will do when President [Donald] Trump wins the White House in 2024. Discovery of 500-million-year-old fossil reveals astonishing secrets of tunicate origins
|

Karma Nanglu says his favorite animal is whichever one he's working on. But his latest subject may hold first place status for a while: a 500-million-year-old fossil from the wonderfully weird group of marine invertebrates, the tunicates.
"This animal is as exciting a discovery as some of the stuff I found when hanging off a cliffside of a mountain, or jumping out of a helicopter. It's just as cool," said Nanglu, postdoctoral researcher in the Department of Organismic and Evolutionary Biology at Harvard University.
In a new study in Nature Communications, Nanglu and co-authors describe the new fossil, named Megasiphon thylakos, revealing that ancestral tunicates lived as stationary, filter-feeding adults and likely underwent metamorphosis from a tadpole-like larva.
Tunicates are truly strange creatures that come in all shapes and sizes with a wide variety of lifestyles. An adult tunicate's basic shape is typically barrel-like with two siphons projecting from its body. One of the siphons draws in water with food particles through suction, allowing the animal to feed using an internal basket-like filter device. Sound of Freedom’ becomes No.1 movie in America on July 4, beating Disney's 'Indiana Jones'

"Sound of Freedom" hit theaters on Tuesday, and due to the "Pay It Forward" technology used by Angel Studios, the true-life thriller, which was reported as tied with Disney/Lucasfilm's "Indiana Jones and the Dial of Destiny," actually beat out the studio giant for the No.1 spot at the box office on Independence Day. As recorded by Box Office Mojo, "Sound of Freedom" grossed over $14 million in total: $11.5 million in direct box office sales and $2.6 million from the Pay It Forward tickets sold through the July 4 holiday. According to Deadline, "Indiana Jones" brought in $11.698M in total despite showing in double the amount of theaters. "Sound of Freedom," shown in only 2,600 theaters, tells the true story of one man's journey to combat child sex trafficking. The Angel Studios film is based on the life of Tim Ballard, a former U.S. Department of Homeland Security agent who left his job because he wanted to do more to rescue children from modern-day slavery.
The film delivers a bold message calling for the freedom of millions of children enslaved in human trafficking, declaring that "God's children are not for sale." The film received an A+ CinemaScore, an 85% critics score and a 99% audience score on Rotten Tomatoes. "Thanks to fans around the country, 'Sound Of Freedom' earned the top spot as America's number one movie on Independence Day. We've received numerous messages telling us theaters are either packed or sold out.
