Supreme Court Orders Title 42 Border Rule to Remain in Effect
|
|
The Supreme Court on Tuesday allowed Title 42, the Trump-era immigration and public health order, to remain in place for the time being.
The high court voted (pdf) 5–4 to grant an emergency request from 19 Republican state attorneys general who sought to intervene in defense of the rule, putting on hold a ruling by District of Colombia Judge Emmet Sullivan, a Clinton appointee, that allowed the rule to expire last week.
Justices Neil Gorsuch, Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson voted against granting the request, while Justices John Roberts, Samuel Alito, Clarence Thomas, Brett Kavanaugh, and Amy Coney Barrett voted in favor. Last week, Roberts, the chief justice, paused the plan to give the Supreme Court more time to look into the issue.
“The stay itself does not prevent the federal government from taking any action with respect to that policy,” the short, unsigned order said Tuesday. “The Court’s review on certiorari is limited to the question of intervention. While the underlying merits of the District Court’s summary judgment order are pertinent to that analysis, the Court does not grant review of those merits, which have not yet been addressed by the Court of Appeals.”
A two-page dissent, written by Gorsuch, stated that the District of Columbia Court’s “intervention ruling takes on whatever salience it has only because of its presence in a larger underlying dispute about the Title 42 orders,” adding that it is “unclear what we might accomplish.”
The 19 states had argued that lifting the policy could lead to an increase in already-record border crossings. Texas Gov. Greg Abbott, meanwhile, pleaded with the Supreme Court and other courts to keep the rule intact, warning that it would lead to a surge in illegal immigration. (Epoch Times) Read more here.

1. AG asks top court to reject petition against Ben Gvir’s appointment as minister - Times of Israel
Attorney General Gali Baharav-Miara asks the High Court of Justice to reject a petition against the appointment of far-right Otzma Yehudit chief Itamar Ben Gvir as national security minister.
Baharav-Miara calls the petition premature as Ben Gvir has not yet taken office and it therefore addresses a theoretical.
Both Ben Gvir and incoming prime minister Benjamin Netanyahu were ordered by the court on Monday to respond to the petition. (Read more)

2. Agreement with Smotrich: Government to expand the Jewish presence in Hebron - Israel National News
As part of the coalition agreements between the Likud and Religious Zionism, the new government will work to strengthen the Jewish settlement in Hebron, Kan Reshet Bet reports.
In the clause that discusses the matter in the agreement, the coalition affirms to enlarge and expand the Jewish settlement in Hebron, the city of the forefathers. This is in addition to general clauses that discuss the fortifying of the settlement of Judea and Samaria in a wider sense.
The reason for adding a specific clause that deals with the Jewish settlement in Hebron is connected to the fact that the city has made headlines recently due to the left-wing activists who came to protest the Jewish presence and due to a filmed confrontation which received a lot of media coverage between the activists and IDF soldiers. 3. Gantz talks security with PA leader Abbas on eve of expected exit - World Israel News
Outgoing Minister of Defense Benny Gantz – who may be out of office as of Thursday night – spoke Wednesday evening with the chairman of the Palestinian Authority (PA) Mahmoud Abbas about the PA’s security arrangements with Israel.
Gantz said that during their conversation, he stressed the importance of what he described as “the relationship that developed between the Israeli security system and the political echelon and the Palestinian Authority.”
Gantz said that he told Abbas he sees it as the utmost importance to continue to maintain an “open channel and the security and civil coordination, which serves the security of both Palestinians and Israelis and enables economic and civil well-being.” (Read more)

4. Lapid: Israel will use force to prevent Iran from going nuclear - JNS
(December 28, 2022 / JNS) Outgoing Prime Minister Yair Lapid reiterated on Wednesday Israel’s “wall-to-wall” commitment to preventing Iran from obtaining nuclear weapons, issuing a threat that Jerusalem would use military power if necessary.
“Two weeks ago, we held a large-scale joint exercise with the U.S. Air Force. The exercise, which simulated an attack thousands of kilometers beyond Israel’s borders, was the first in a series of planned exercises in the near future,” Lapid said at an Israel Air Force pilots’ course graduation ceremony at the Hatzerim Air Base near Beersheva.
“Our enemies will need to know that we will not sit idly by in the face of threats that we deem to be existential. I discussed this with incoming Prime Minister [Benjamin] Netanyahu and this is one of the few topics on which there is wall-to-wall consensus among the Israeli public. No Israeli government will allow a nuclear Iran. If it is necessary to act, we will act,” Lapid added. (Read more)

5. Menorah in Coney Island Destroyed Amid Wave of Antisemitic Vandalism Incidents Across the World - Algemeiner
A menorah in the Coney Island section of Brooklyn, New York was vandalized this week.
Others across the world have met the same fate, according to several reports by StopAntisemitism, a US-based watchdog group, with similar incidents occurring in New York City, Beverly Hills, Berlin, as well as in Rockland, Maine, and Temuco, Chile.
“We are saddened to hear the Coney Island Chabad Menorah has been vandalized, adding to those globally that have also been broken or destroyed this Hanukkah season,” the group tweeted on Tuesday. (Read more)

1. Democrats propose to 'criminalize election misinformation' - The Post Millennial
Democrats are working hard to retain their hold on power, and nowhere is that motivation clearer than their attack on free and fair voting practices. One of the Democrats' plans is to criminalize what they call election "misinformation." "Some of the proposals," The New York Times reports "include... criminalizing election misinformation."
The Democrats' have used the term "misinformation" to refer to information that they believe poses a challenge to their power. As regards voting, they have said that it is "misinformation" to state concerns about ballot harvesting, mail-in voting, or even concerns over misprinted ballots that are unable to be read by voting machines.
In Maricopa County, Arizona, election officials had to apologize for broken machines during the 2022 midterm elections. Concerns over voting integrity in that state are called misinformation anyway. (Read more)

2. Southwest Airlines has 'another tough day' as CEO warns flight cancellations will continue - Just The News
Southwest Airlines CEO Bob Jordan on Tuesday warned that large-scale cancellations of its flights were likely to continue after the airline on Monday cancelled a majority of its flights and more major cancellations the following day.
Southwest on Monday cancelled 2,909 flights, or 71% of its planned trips. It further cancelled 2,626 flights, or 64% of its flights on Tuesday, according to FlightAware. The cancellations come amid a large winter storm that has wreaked havoc on western New York, in particular. While nearly all airlines were forced to cancel some flights, Southwest was far and away the outlier in terms of the percent of cancellations.
As of press time, there have been 3,088 cancelled flights within the U.S. or with a start or end point within the country, meaning Southwest has been responsible for more than 73% of Tuesday's cancelled flights. (Read more)

3. Christians face genocide amid rise in persecution in at least 18 countries, report warns - Just The News
Christians are facing genocide in several countries as the persecution of followers of the religion has increased in at least 18 nations, according to recent research.
The Catholic group Aid to the Church In Need released a report earlier this year titled, "Persecuted and Forgotten? A Report On Christians Oppressed For Their Faith 2020-22," which highlighted "human rights violations" against Christians in 24 countries.
The group found that persecution increased in 75% of the countries surveyed.
In Africa, "extremism threatens previously strong Christian communities," the report states. "In Nigeria and other countries, this violence clearly passes the threshold of genocide." The report also found that Christians are experiencing genocide in Ethopia's Tigray region and in North Korea. (Read more)

4. Florida Gov. DeSantis' office to investigate drag show event for exposing children to inappropriate content - Fox News
Florida Gov. Ron DeSantis' administration announced Tuesday that it is investigating a Christmas drag show event that allegedly exposed children to "sexualized acts." The event, which was held at the Broward Center of the Performing Arts in Fort Lauderdale, was part of a national tour for "A Drag Queen Christmas."
The event, which was first reported by The Floridian, allegedly features sexually provocative content and expressions content, such as "t-ts in a box" and lewd dances.
Bryan Griffin, press secretary for DeSantis, published a statement about the incident.
""The Department of Business and Professional Regulation (DBPR) is aware of multiple complaints about a sexually explicit performance marketed to children held in Fort Lauderdale on December 26th. The Department is actively investigating this matter, including video footage and photographs from the event. DPBR will, like in other cases, take action," the statement read. "Exposing children to sexually explicit activity is a crime in Florida, and such action violates the Department’s licensing standards for operating a business and holding a liquor license.” (Read more)

5. South Korea Sends Drones to Kim Jong Un’s Airspace in Unprecedented Move - Yahoo News
South Korea sent drones across the border into North Korea for the first time on Monday, an unprecedented tit-for-tat military move after Kim Jong Un’s regime dispatched five unmanned aerial vehicles into its air space.
The exchange of drones, which briefly stopped flights from taking off at major airports near Seoul, came as Kim opened a major political meeting to set security, economic and political policy for the coming year, the official Korean Central News Agency reported Tuesday. He has spent the past year improving his atomic arsenal, showing no interest in returning to nuclear disarmament talks that have been stalled for three years.
Kim’s regime sent five drones across the border on Monday, the first time he has done so in more than five years. The first one crossed the border at 10:25 a.m. and returned after flying for about three hours. Four more were detected Monday afternoon and later vanished from radar, South Korea’s Joint Chiefs of Staff said. (Read more)

In coaching we have a saying, “Control what you can control.” In other words, focus on what you can do and do it. Unfortunately, many have become very adept at recognizing problems, but few have taken the step to control what they can control. Case in point is the anti-Christian, anti-American brainwashing that is taking place in the public school system. Many complain about it. Few are doing anything about it. Same with colleges and universities. “What can we do?” is so often asked. Most don’t realize that the education of their children is the responsibility of the parents and the taxpayers who live in the school districts. There is control. People don’t have to accept the nonsense.
I recently had a conversation with a very dear young man. All he could talk about is how bad America was and is, and how other countries like China and India are so much better. He also pontificated on the stupidity of the English language. He is only 16 and is in AP classes at a public school. Robert Knight, columnist for the Washington Times, recently wrote an article documenting how the extreme leftists in education are restructuring the English language as “part of the Left’s plan to turn the U.S. into an updated version of the Soviet Union.” It’s outright Marxism designed to destroy this nation from within by ideological subversion, a brainwashing technique designed to change a person’s perception of reality. Likud leader Benjamin Netanyahu will attempt to swear in his governing coalition of far-right and ultra-Orthodox parties on Thursday, Knesset Speaker Yariv Levin said Monday, with the former premier looking to retake power before a deadline to get his unruly partners in line.
Levin formally informed the Knesset plenum on Monday of Netanyahu’s announcement last week that he could form Israel’s next government, starting a seven-day clock for the coalition of three far-right parties and two ultra-Orthodox parties, in addition to his right-wing Likud to be officialy sworn in.

A space telescope designed to search for the hardest-to-find asteroids and comets that stray into Earth’s orbital neighborhood, NASA’s Near-Earth Object Surveyor (NEO Surveyor) recently passed a rigorous technical and programmatic review. Now the mission is transitioning into the final design-and-fabrication phase and establishing its technical, cost, and schedule baseline.
The mission supports the objectives of NASA’s Planetary Defense Coordination Office (PDCO) at NASA Headquarters in Washington. The NASA Authorization Act of 2005 directed NASA to discover and characterize at least 90% of the near-Earth objects more than 140 meters (460 feet) across that come within 30 million miles (48 million kilometers) of our planet’s orbit. Objects of this size are capable of causing significant regional damage, or worse, should they impact the Earth.
“NEO Surveyor represents the next generation for NASA’s ability to quickly detect, track, and characterize potentially hazardous near-Earth objects,” said Lindley Johnson, NASA’s Planetary Defense Officer at PDCO. “Ground-based telescopes remain essential for us to continually watch the skies, but a space-based infrared observatory is the ultimate high ground that will enable NASA’s planetary defense strategy.” Read More

Study: Homeschoolers Outperform All Other Students on Standardized Test

Numerous studies have shown that homeschooled students continue to academically outperform their private, charter, and public school counterparts. Now, a new study about homeschoolers taking the Classic Learning Test, a standardized college entrance exam, reveals they are scoring higher than their peers in other educational settings. The tests, according to the CLT website, emphasize intellectual aptitude and achievement and are grounded in the liberal arts tradition. The exam utilizes reading passages from classic texts written by individuals "whose writings have had a lasting influence on culture and society" rather than the informational passages and more contemporary writings often used in the SAT and ACT, according to The Daily Wire.
The outlet reports a new analysis of the CLT results by Houston Christian University professor Lisa Treleaven found that homeschool students who took the exam earned mean scores of roughly 78 points, surpassing private school students, who earned mean scores of 75, and charter school students, who earned mean scores of 73. Public school students earned mean scores of 66, marking the lowest among the cohorts considered by the study. Treleaven wrote, "This is consistent with prior research findings of superior academic performance of homeschool students as compared to other school types." The professor's 15-page study was based on the exam results of 12,000 students who took the CLT from 2016 - 2021.
Classic Learning Test CEO Jeremy Tate who created the CLT seven years ago, suggested to The Daily Wire that the freestyle structure of homeschooling may give an advantage over students enrolled in other schools. "Homeschooled students simply have more time for leisure reading," he told the outlet. "We forget that the word school derives from Greek scholē, originally meaning leisure. The connection between leisure and learning is profound. Factory model schooling is antithetical to leisure, but is common for homeschooled students who are given the time and space to immerse themselves in great literature." In essence, homeschooling lets the children improve as per their nature and schedule. according to Admissionsly.com.
Treleaven's analysis shows that homeschooled students significantly outdid their peers on the verbal and writing portions of the CLT. But were about equal with private and charter school students' test scores on the quantitative portion of the test. The professor also called for more research on homeschool academic achievement. According to the National Home Education Research Institute, (NHERI) homeschooled children typically score 15 to 30 percentile points above public-school students on standardized academic achievement tests.
