Congress 'Put Itself Above the Law' in Trump Impeachment: Dershowitz

Harvard Law School professor emeritus Alan Dershowitz said Saturday that congressional lawmakers are violating the U.S. Constitution in what he described as a “show trial” against former President Donald Trump. The House impeachment brief alleges that Trump incited a mob to breach the U.S. Capitol on Jan. 6 while lawmakers were convened in a joint session to consider certification of electoral college votes. Trump’s legal team denies the allegation and argues in a memo that the trial is unconstitutional because Trump is no longer president. The team also argues that Trump exercised his First Amendment rights in calling into question the results of the election.

Dershowitz argued that an effective legal defense is based on challenging the constitutionality of the allegations against Trump. “The best arguments he can make, and he will make, are the constitutional ones, namely the Senate had no jurisdiction over a former president and the speech was covered by the First Amendment,” Dershowitz told Newsmax in an interview. “Congress has put itself above the law,” Dershowitz added. “They say the president is not above the law; they’re right, but Congress is not above the law, and the law makes specific provisions for when a president can be impeached and you can’t impeach a president in violation of the First Amendment.”

He said Thursday that the House impeachment brief against former President Donald Trump, which seeks to undermine Trump’s First Amendment-based argument in his defense, amounts to a dangerous broadside against the freedom of speech of all Americans. (Read more)

1. Israel's Benjamin Netanyahu vows to fight 'anti-Semitic' ICC ruling - The Straits Times

JERUSALEM (AFP) - Israel's Prime Minister Benjamin Netanyahu on Saturday angrily rejected an International Criminal Court's (ICC's) ruling that paves the way for a war crimes probe into the Israeli-occupied Palestinian territories, condemning it as "pure anti-Semitism".

"As prime minister of Israel, I can assure you this: we will fight this perversion of justice with all our might," Netanyahu said in a statement. "This is pure anti-Semitism."

On Friday, the ICC ruled that it has jurisdiction over the situation in the occupied Palestinian territories, paving the way for the tribunal to open a war crimes investigation. (Read more) 

2.  Israeli MK: B’Tselem Received Foreign Funding to Aid ICC Against Israel - Jewish Press

The B’Tselem rights organization received funds from foreign governments to engage the International Criminal Court (ICC) in The Hague in a probe against what they define as Israel’s “occupation” in Judea and Samaria, Member of Knesset (MK) Ariel Kallner charged.

Kallner, head of the Knesset’s Lobby for the Fight Against Delegitimization and Anti-Semitism, revealed Saturday that B’Tselem received 290,000 euros from foreign governments to prove that the Israeli legal system is enlisted to support Israel’s “occupation policy,” pushing the ICC to intervene.

He published the data following the ICC’s ruling on Friday that its jurisdiction extends to territories liberated by Israel in the 1967 Six-Day War, possibly clearing the way for its chief prosecutor to open war crimes probes into Israel’s military actions and its presence in Judea and Samaria. (Read more)

3.  On trial during elections? Timetable at stake as Netanyahu back in court Monday - Times of Israel

After several delays due to the coronavirus lockdown, a much-anticipated court hearing in the corruption trial of Prime Minister Benjamin Netanyahu will take place at 9 a.m. Monday at the Jerusalem District Court, with the premier and the other defendants required to attend.

The hearing will focus on Netanyahu’s response to the criminal indictment against him and launch the evidentiary stage of the trial. It will be the second time Netanyahu attends a hearing of his trial in person.

He will likely be required to verbally confirm the defense filed by his lawyers, who will present a series of verbal arguments in addition to their lengthy written response filed to the court last month.

4. Israeli hospital claims it has developed drug to cure serious cases of COVID - JNS

(February 5, 2021 / JNS) Researchers at Israel’s Ichilov Hospital, Tel Aviv Sourasky Medical Center claim that they have developed a drug that may cure serious cases of the coronavirus.

According to the hospital, 29 out of 30 patients with moderate-to-severe cases of COVID-19 were administered the drug, named EXO-CD24, and experienced a marked recovery in just two days. They were released from the hospital three to five days later.

The medication, developed by Professor Nadir Arber from the hospital’s Integrated Cancer Prevention Center, fights the cytokine storm—is a potentially life-threatening systemic inflammatory syndrome that is believed to be responsible for many coronavirus deaths.

“The medicine is administered through inhalation, once a day, in a procedure that takes only a few minutes, for five days,” explained Arber. (Read more)

5. Cabinet gives Air Force multibillion dollar blank cheque - Israel National News

The National Security Cabinet this evening (Sunday) approved for the Ministry of Defense and the IDF a long-term plan for financing a substantial procurement for the Air Force. The outline will include a long-term loan and will include the purchase of fighter jets, heavy transport helicopters and advanced armaments worth billions of dollars.

The Ministry of Finance lost the battle when the Ministry of Defense and the IDF won the approval of the Cabinet to close the deal. The dispute between them included the Ministry of Defense insisting on financing the deal through a long-term loan deferred to the end of the decade, including high interest rates.

After the approval of Attorney General Avichai Mandelblit and the national security cabinet, the army was given the green light to choose the future heavy transport helicopter between the Chinook and the CH53K helicopter. Defense Minister Bnei Gantz demanded that the Air Force present him with the possibility of including the V-22 aircraft in the mix. According to security sources, the Air Force will present the recommendations next week. It was also decided that as part of the financing, the Air Force would purchase another squadron of F-35 JSFs, as well as advanced armaments.

6. US Commander for the Middle East Visits Israel - Bridges for Peace

Monday, 1 February 2021 | What happened: US Gen. Kenneth F. McKenzie Jr., the Commander of CENTCOM—the US Central Command for the Middle East—arrived in Israel last week for a two-day visit.

·  It is the first high-level visit by a top American official since US President Joe Biden was sworn in.
·  General McKenzie participated in a panel led by the Chief of the General Staff.
·  IDF Chief of Staff Lt. Gen Aviv Kochavi said: “Military and strategic relations between the US and Israel have, for many years, been a critical component in establishing Israel’s national security and its advantage over its enemies, wherever they are. This partnership has a key role to play in dealing with our common threats, especially the Iranian threat.”
·  Israeli Defense Minister Benny Gantz spoke with his American counterpart, Lloyd James Austin III, in an introductory call last week. Gantz highlighted the importance of confronting Iranian aggression to ensure regional stability and underlined the centrality of ongoing dialogue and strategic coordination at every level of interface between the two defense establishments.
·  Austin reaffirmed the strength of the US–Israel defense relationship and reiterated the US commitment to maintaining Israel’s Qualitative Military Edge.

Context: In the last days of [former] President Donald Trump, the US moved Israel from the jurisdiction of the European Command (EUCOM) in the US military to the Central Command.

  • The switch was made as relations between Israel and several Arab and Muslim states have normalized in the past year.

  • Israeli officials have long said the move to CENTCOM is of strategic significance for Israel and will allow for closer coordination and cooperation with the US military, particularly with a focus on Iran. . . .

7. Israel Conducts Secretive Iron Dome Tests, Achieves “Significant Milestone” - Bridges for Peace

Tuesday, 2 February 2021 | A “new and upgraded” Iron Dome missile defense system has been successfully tested by Israel’s Missile Defense Organization and achieved a “significant milestone” in the weapon’s development—but the Israelis weren’t forthcoming with many details about what that accomplishment is.

The press release put out by Israel’s Ministry of Defense only said the test campaign included “a number of scenarios simulating advanced threats with which the Iron Dome is expected to contend during times of conflict—whether on land or in the sea.”

The vague and apparently secretive tests come as Israel faces an ongoing threat from Iran, who may be motivated to launch militaristic or terrorist attacks. The Islamic Republic was outraged over the assassination of nuclear scientist Mohsen Fakhrizadeh last November, January marked one year since Iranian spymaster General Qassem Soleimani was killed by the United States, and the Iranians continue to escalate their nuclear crisis with the world powers in a blackmail effort to convince the US to alleviate sanctions.

With that in the background, Twitter posts from Israel’s Defense Ministry and Defense Minister Benny Gantz offered no additional details on the latest Iron Dome test campaign beyond the press release. However, Gantz did tweet on the tests, saying in a Hebrew post translated by Google: “Glad to update that we have successfully completed a complex series of experiments in an advanced version of Iron Dome. The security system will continue to be on guard around the clock and everywhere.” (Read more)

- Praise the Lord that the Iron Dome will be “on guard around the clock and everywhere,” including protecting Israel’s coastal boarder. At the same time, beseech the Lord that such equipment will never have to be used and pray that all Israel will recognize the God of Abraham, Isaac and Jacob as their Shield and Defender.

1. Trump Lawyers to Use Videos of Democrats Allegedly Inciting Violence During Impeachment Defense - The Epoch Times

President Donald Trump’s lead impeachment defense attorney Bruce Castor said he will use video clips of top Democrats allegedly inciting violence during the forthcoming trial in the Senate. Castor said the defense team will adhere to the strategy outlined in the brief they submitted to the Senate on Tuesday. The Trump defense team argued in the brief that the Constitution “requires that a person actually hold office to be impeached” and that Trump was exercising his First Amendment right of free speech to question the results of the November election. The impeachment against Trump goes against the Constitution because Trump doesn’t hold any office after he left the White House on Jan. 20, the lawyers argued.

Castor revealed that the defense team will use some video clips of top Democrats encouraging violence during the impeachment trial which is scheduled to start on Monday. “I think you can count on that,” he told Fox’s Laura Ingraham. . . Castor noticed that some Democrats nationwide cheered when the rioters were burning down the cities and attacked the federal law enforcement officers last summer in the aftermath of the death of George Floyd.

“Many of them [Democrats] in Washington using really the most inflammatory rhetoric as possible to use,” he said. “But here when you have the president of the United States give a speech and says ‘you should peacefully make your thinking known to the people in Congress,’ he all of a sudden the villain. So you better be careful what you wish for.”

During his Jan. 6 speech which later became the focus of the Democrats’ impeachment against him, Trump told his supporters: “I know that everyone here will soon be marching over to the Capitol building to peacefully and patriotically make your voices heard.” (Read more)

2. Supreme Court to Consider 2020 Election Challenge Lawsuits in February Conference - The Epoch Times

The U.S. Supreme Court on Friday scheduled several high-profile contest-of-election lawsuits, including ones brought by attorneys Sidney Powell and Lin Wood, and the Trump campaign, for consideration at its Feb. 19 conference. According to a case listing, the lawsuits include Sidney Powell’s Michigan case (20-815), the Trump campaign’s Pennsylvania lawsuit (20-845) and Wisconsin lawsuit (20-882), the Pennsylvania lawsuit brought by Rep. Mike Kelly (R-Pa.) (20-810), and Lin Wood’s Georgia case (20-799).

All cases allege some form of unlawful election-related conduct affecting the result of the election, including expansion of mail-in balloting by elections officials changing rules in contravention of state election laws, lack of adequate security measures around mail ballots, issues with machine vote tabulation, and denial of meaningful access to poll watchers. The Supreme Court declined to grant relief or fast-track the cases as requested in respective petitions filed ahead of the Jan. 20 inauguration of President Joe Biden. (Read more)

3. Biden says Trump shouldn't get intel briefings - The Hill

President Biden said Friday that he does not believe that former President Trump should continue to receive intelligence briefings. Biden said in an interview on "CBS Evening News with Norah O’Donnell" that he does not believe Trump should still receive intelligence briefings “because of his erratic behavior unrelated to the insurrection,” referencing the Jan. 6 riot by Trump supporters at the U.S. Capitol.

Biden reiterated his belief that Trump represents an “existential threat" and “dangerous.” Asked about his worst fear if Trump continues to receive intelligence briefings, Biden declined to speculate but suggested he sees no value in Trump continuing to receive intelligence. “I'd rather not speculate out loud. I just think that there is no need for him to have the intelligence briefings. What value is giving him an intelligence briefing? What impact does he have at all, other than the fact he might slip and say something?” Biden said.

The White House said earlier this week that its national security team is conducting a review to determine whether Trump should continue to receive intelligence briefings after having left office. CNN reported Thursday that the U.S. intelligence community would review any requests for intelligence briefings from Trump, in keeping with normal practice. (Read more)

4. New Defense chief orders stand-down to rid ranks of 'racists and extremists' - WND

The Pentagon has admitted it's unsure how to address the problem or even how serious it is, but the newly confirmed secretary of defense has ordered a stand-down with the ultimate objective of removing white nationalists from the ranks. Lloyd Austin, the first black defense secretary, emphasized in his confirmation hearing Wednesday the need to rid the military of "racists and extremists." He didn't say how long the stand-downs pausing military activity would last or how commanders would address the issue.

Pentagon spokesman John Kirby said military leaders must show progress in combating extremism after current and former military servicemembers were found to have participated in the siege of the U.S. Capitol on Jan. 6, Reuters reported. The wire service noted, however, that the Pentagon has not said how it will deal with extremism and has not presented data estimating how many service members hold white nationalist ideology. "We don't know how we're going to be able to get after this in a meaningful, productive, tangible way and that is why he had this meeting today and that is why he certainly ordered this stand-down," Kirby told reporters. (Read more)

5. Republican Accountability Project Launches Ad Campaign to Get Cruz and Hawley to Resign - Politicsususa.com

The Republican Accountability Project has launched an ad campaign to force Senators Ted Cruz (R-Texas) and Josh Hawley (R-Mo.) to resign over their decision to vote against the Electoral College certification after a mob of former President Donald Trump’s supporters violently stormed the Capitol in a bid to overturn the results of an election that President Joe Biden won handily. “You lied about the election. The Capitol was attacked,” the billboards read.

The billboard campaign cost the group $1 million. The group made headlines earlier this month for announcing it would donate $50 million to reelect any members of the GOP who vote to impeach or convict Trump for inciting the insurrection against Congress. Details about the campaign were first discussed with Politico. “The billboards will be placed in each House member’s district, as well as in multiple cities in Texas and Missouri targeting Cruz and Hawley,” the outlet reported.

“These representatives and senators helped incite the attack on the Capitol by spreading lies about the election,” said Sarah Longwell, the executive director of the Republican Accountability Project. “They have proved that they are unfit to hold office. They should be nowhere near power.” (Read more)

6. Biden Orders Agencies to Promote LGBT Rights Worldwide: The 'U.S. Belongs at the Forefront' - Christian Headlines.com

President Biden said in a memorandum Thursday that his administration will “advance the human rights” of LGBTQ individuals around the world by building on principles established in 2011 under the Obama administration. The White House released the memorandum shortly after Biden said in a speech at the State Department that he wants his agencies to “reinvigorate our leadership on the LGBTQI issues and do it internationally.” The memorandum says, “brave lesbian, gay, bisexual, transgender, queer, and intersex (LGBTQI+) activists” around the world “are fighting for equal protection under the law, freedom from violence, and recognition of their fundamental human rights.”

“The United States belongs at the forefront of this struggle – speaking out and standing strong for our most dearly held values,” the memorandum says. “It shall be the policy of the United States to pursue an end to violence and discrimination on the basis of sexual orientation, gender identity or expression, or sex characteristics, and to lead by the power of our example in the cause of advancing the human rights of LGBTQI+ persons around the world.”

The memorandum impacts such agencies as the Departments of State, Treasury, Defense, Justice, Agriculture, Commerce, Labor, Health and Human Services, and Homeland Security. (Read more)

7. Twitter suspends major Christian group on mind-boggling grounds - WND

It's not just President Trump and the MyPillow guy Mike Lindell who are facing the wrath of Twitter in recent days. Now, the social-media giant has suspended Focus on the Family, an influential Christian-based family organization. The supposed crime? Its "Daily Citizen" publication stated factual information regarding the biological sex of Rachel Levine, President Biden's assistant secretary for health at the Department of Health and Human Services.

"As I've noted before, Big Tech titans are the new emperors of the twenty-first century, wielding an inordinate amount of power by silencing individuals and organizations that don't comport or cave to their political or social point of view," wrote Jim Daly, president of Focus on the Family. "This past week, Twitter locked The Daily Citizen for an alleged rules violation, specifically that we had posted 'hateful' content. It's simply not true. We did no such thing," he continued.

At issue was a Tweet pointing to a story about Dr. Rachel Levine, President Biden's controversial nominee for Assistant Secretary for Health at the Department of Health and Human Services. The tweet included the following sentence: "Dr. Levine is a transgender woman, that is, a man who believes he is a woman."

. . . The article itself had absolutely nothing to do with Dr. Levine's "trans" identification. It had to do with his fitness for the job based on his previous record. We've asked Twitter to explain what was wrong with our wording and even asked them how we might describe Dr. Levine to their liking. At this writing, we haven't heard back. Over the course of the last week, President Biden has been stressing the need for unity – but his actions since taking office are all about demanding uniformity. There appears to be no room for convictional disagreement. You will comply – or be silenced.

The "Cancel Culture" is barreling down the track like a runaway train on a mountain pass, threatening to run over anyone in its path.

"It goes on and on. And we're only at the beginning of a coordinated effort to silence those of us with socially conservative convictions," Daly said. "Please be in prayer for us as we navigate this cultural maelstrom. In reality, this tension over free speech and religious liberty have existed from the earliest days of the country – but it's exacerbated and magnified in this post-Christian era." (Read more)

8. Iran’s Khamenei: US must lift sanctions before we return to nuclear deal - Times of Israel     

Iran’s Supreme Leader Ayatollah Ali Khamenei said Sunday that the United States must lift all sanctions before Tehran reverses any nuclear production steps.  The Trump administration reimposed sanctions on Iran in 2018 after pulling the US out of the international accord aimed at curtailing Tehran’s nuclear program.

“The side with the right to set conditions to JCPOA is Iran since it abided by all its commitments, not US or 3 European countries who breached theirs,” Khamenei wrote on Twitter, referring to the Joint Comprehensive Plan of Action and France, Germany and the United Kingdom. “If they want Iran to return, US must lift all sanctions. We’ll verify and if it’s done properly, we’ll return to our commitments,” Khamenei wrote.

The top diplomats of Britain, France, Germany and the United States held talks on Friday for the first time in almost three years that included discussions on Iran.  hamenei’s statement came a day after Iranian Foreign Minister Mohammad Javad Zarif told an Iranian newspaper that recent parliament legislation forces the government to toughen its stance on the US if sanctions are not eased in two weeks, the Reuters news agency reported. In December, the Iranian parliament, led by hardliners, passed legislation that set a two-month deadline for the easing of sanctions.

Also on Saturday, the Wall Street Journal reported that United Nations nuclear inspectors found traces of radioactive material at Iranian nuclear sites that could indicate work on nuclear weapons. The report cited several unnamed diplomats briefed on the matter, who said the locations in which the material was found contributed to suspicions. Tehran barred inspectors from accessing those same locations for a number of months last year, it said. (Read more)

Trump's Efforts to Fight Sex Trafficking Made 'Incredible Impact': SHAREtogether Founder 
 

Jaco Booyens, the founder of SHAREtogether, said former President Donald Trump’s efforts to create an office dedicated to fighting sex trafficking made an “incredible impact” over the last four years. SHAREtogether is a nonprofit organization dedicated to combating child sex trafficking.

Booyens was interviewed by NTD on Friday and asked to expound on the big sex trafficking bust that occurred in California this week. Sixty-four people were arrested and two women were rescued in an anti-human trafficking sting in California’s Riverside County. The Riverside County Sheriff’s Department said the arrests were part of Operation Reclaim and Rebuild, an annual statewide operation. The sting “ran for four consecutive days before concluding on January 28, 2021,” the department said on Tuesday.

“It’s a big orchestration, to execute a sting or a bust, like what we’ve just seen in California, and it takes months and months of planning and funding. And that’s why it’s very important for both local and federal, local, state, and federal government to support the fight against sex trafficking, because you cannot do it on your own,” Booyens said. He noted that for these operations to succeed, they need to be able to be conducted in a way that they can have standing in court, and some connections between the judicial system and the police have to exist.

Booyens said that before Trump “we’ve never had an office in the White House designated and dedicated to fighting sex trafficking. No former president in the history of this country has used his or her platform to denounce the exploitation of children and then appropriate funding. So we’ve seen an incredible impact over the years, over the last four years, particularly towards the support for law enforcement.”

Regular police officers, he said, are not trained to investigate, profile, or conduct a sting operation. It requires special training and a lot of resources and effort.

“We’ve seen a tremendous rise in the apprehension, the arrest of perpetrators and rescue of victims under the Trump administration, no question about it,” Booyens said. “In these cases that you’re seeing now such as California, and you’ll see some others coming out now, they’ve been 9, 10 months in the making under the Trump administration—in that mechanism of funding law enforcement appropriately, having special task forces.” (The Epoch Times)

71 Arrested for Human Trafficking Before Superbowl


71 arrested in month-long human trafficking operation in Hillsborough County

On National Human Trafficking Awareness Day, the Hillsborough County Sheriff's Office announced 71 people were arrested in a month-long investigation known as "Operation Interception."

The operation, according to HCSO, was created to "combat human trafficking leading up to the Super Bowl coming to Tampa in February 2021."

"With less than a month until the big game, our covert operations continue, seeking those who choose to sexually exploit others here in our community,” said Sheriff Chad Chronister. “Our goal, as the operation name explains, is to ‘intercept’ individuals involved in sexual exploitation before they are able to take advantage of vulnerable individuals, and ultimately, to deter others."

During the month-long operation, which ran from December 7, 2020, through January 9, 2021, undercover detectives posted online ads saying they were available to meet up and sell themselves for sex. Female detectives also posed as prostitutes on the streets.

71 "Johns" were arrested and charged with soliciting another to commit prostitution or entering/remaining in a place for prostitution. Some received additional charges, including drug possession.

“Like any major sporting event, the Super Bowl should not be a venue where these types of crimes occur on the sidelines, whether it's before, during, or after the game,” said Sheriff Chronister. “We know from past experiences with major sporting events that there will be some who travel for the exclusive purpose of taking advantage of women and children. I want to make it very clear, if you are planning to engage in the sexual exploitation of others, I’m urging you to think twice. In Memoriam: Office Brian Sicknick


The following report was released by Pastor Dan Cummins, Capitol Worship Ministry and a friend of our own ministry. We join Pastor Dan today in honoring the memory of this officer, who died in the line of duty on January 6th inside the Capitol building. We remember, too, and honor two others who have also fallen in the line of duty: Officer Jacob J. Chestnut Jr., and Detective John M. Gibson who died on July 24, 1998, while protecting the office of then-Majority Whip Congressman Tom DeLay. May all now rest in peace.

Pastor Dan was asked by the family of the late fallen USCP Officer Brian D. Sicknick, who died from head injuries sustained on January 6, to give his eulogy at his memorial service in the US Capitol Rotunda Tuesday evening.

Steve Amerson sang "Amazing Grace" in the hallowed dome where only five civilians have had the distinction to lie in honor. Brian joins his fellow fallen comrades Officer Jacob J. Chestnut Jr., and Detective John M. Gibson (who also died protecting the Capitol from a crazed gunman), civil rights activist Rosa Parks and the Rev. Billy Graham as the only private citizens to share this sacred place of honor.

Those in attendance at the Tuesday evening Receiving Ceremony included leadership from the U.S. Congress, Speaker of the House Nancy Pelosi, Senate Majority Leader Charles Schumer, House Majority Leader Steny Hoyer, House Minority Leader Kevin McCarthy and Minority Whip Steve Scalise. The new USCP Chief Pittman and other top USCP leadership, Brian's Mountain Bike Unit and the extended Sicknick family were present.

Unfortunately this portion of the ceremony was not aired publicly on television. Brian's complete written eulogy is provided at the link below.

Brian was a regular at our Saturday evening USCP SERVE. He will be greatly missed by all.

150 feared dead after Himalayan glacier bursts northern India dam

The Nanda Devi Glacier in the Himalayas of northern India has been in the news the last few days, leading to a deadly disaster on Sunday.

A piece of the glacier broke off on Sunday, hitting and damaging part of a hydroelectric dam in India's northern state of Uttarakhand, according to Reuters. The damage resulted in torrents of water that could be seen bursting out of the banks of the river Dhauli Ganga Sunday morning, forcing villages downstream to evacuate.

While the evacuations likely saved numerous lives, reporters were told by State Police Chief Ashok Kumar that more than 50 people working at the dam, the Rishiganga Hydroelectric Project, were among those feared dead.

India's Prime Minister, Narendra Modi said he was closely monitoring the situation shortly after catching wind of the incident.

“India stands with Uttarakhand and the nation prays for everyone’s safety there,” he said on Twitter. "I have been speaking to senior authorities and getting updates on NDRF deployment, rescue work and relief operations," he added.

Members of India's Air Force have prepared for assistance with rescue operations in the area. They will reportedly be flying in disaster-response teams to the area in order to provide aid to those affected as quickly as possible.(Accuweather) Read more.

Supreme Court allows California churches to hold indoor services at limited capacity

After months of legal battles over Gov. Gavin Newsom’s COVID-19-related restrictions, churches in California can finally restart their indoor worship services, though only at 25% capacity, the U.S. Supreme Court ruled Friday night.

“We are not scientists, but neither may we abandon the field when government officials with experts in tow seek to infringe a constitutionally protected liberty,” Justice Neil Gorsuch wrote, joined by Justices Clarence Thomas and Samuel Alito.

“Even if a full congregation singing hymns is too risky, California does not explain why even a single masked cantor cannot lead worship behind a mask and a plexiglass shield,” Gorsuch added. “Or why even a lone muezzin may not sing the call to prayer from a remote location inside a mosque as worshippers file in.”

Justices Elena Kagan, Stephen Breyer and Sonia Sotomayor dissented.

The ruling came in a case led by South Bay United Pentecostal Church in the San Diego area, noted Politico, which reported that the court released a similar order in a parallel suit filed by Harvest Rock Church in Pasadena. The churches argued that they should have the same freedom as shopping malls and retail businesses that are allowed to operate at 25% of their capacity.

Chief Justice John Roberts took a middle path and voted, along with Justices Brett Kavanaugh and Amy Coney Barrett, to lift the ban on indoor worship while retaining the restriction on singing, according to The Wall Street Journal.

“The applicants bore the burden of establishing their entitlement to relief from the singing ban. In my view, they did not carry that burden—at least not on this record,” Barrett wrote. (Christian Post) Read more here.
